PERSON ACCUSED OF ATTEMPTING TO COMMIT MURDER ON REGULAR BAILThe person accused of attempting to commit murder has been granted regular bail, stirring discussions on the judicial process and bail conditions.

Accused namely Sheikh Shahrukh Sheikh Qayyum has been granted regular bail by Sessions Judge Shri Jadhav. The police station Wathoda registered Crime no: 77/2024 for an offense punishable u/s 307 of IPC dated 1-03-2024 based on a complaint lodged by Rupesh Gubrele.

Accordingly, Sheikh Shahrukh Sheikh Qayyum was arrested on 1-03-2024 and since then he has been languishing in jail. , the recitals of the first information report reflect the allegation that, on 29.02.2024 in the evening informant Rupesh Gubrele reached RBR Restaurant and Beer Bar to consume the liquor. Thereafter, the applicant/accused Sheikh Shahrukh also came there for the same purpose, suddenly accused Sheikh Shahrukh was assaulted using a knife on the left thigh of the informant/injured informant Rupesh Gubrele and caused the injury. It is alleged that the applicant/accused Sheikh Shahrukh was assaulted using a knife on the person of injured informant Rupesh Gubrele to kill him. Based on a report lodged by the informant/injured present crime No.77/2024 of the offence punishable under section 307 of the Indian Penal Code was registered against an applicant on 01.03.2024 at Wathoda Police Station. PSO PS Wathoda Shahrukh on 01.03.2024 and produced before learned JMFC for further custody according to law. It was submitted that the injured has already been discharged from the hospital and there is no chance of conversion of offense under sec 302 of IPC. It was submitted that the nature of the injury suffered by the informant is only a single would suffer on the thigh. It is submitted that the nature of the injury suffered by the victim is not grievous and part of the body where assault was made shows that, there was no intention to kill the deceased.

It was submitted that a perusal of FIR itself shows that, the informant initially went to a private hospital got himself treated and lodged FIR himself which itself shows that the informant only required initial treatment which is sufficient to show that, there was no serious injury caused to informant requiring invocation of sec 307 of IPC. Adv Mir Nagman Ali appeared for Sheikh Shahrukh Sheikh Qayyum.
