Mombay HC Releases Murder Accused on Bail.

Single Bench presided over Urmila Joshi Phakle J has released accused Sharik Khan S/o Ayyub Khan R/o Mominpura Nagpur on regular bail.

Sharik Khan S/o Ayyub Khan was arrested on 24-10-2021 for the offence punishable under sections 302, 143, 147, 148, 149, 120B, 201 of IPC R/w Sec 3(2)(V), 3(2)(Va) Of Scheduled Castes And Scheduled Tribes (Prevention Of Atrocities) Act vide Crime No. 867/2021 dated 21-10-2021 by the Police Station Pachpaoli, Nagpur on the report of the complainant Shashim Pravin Shambharkar.

The case of prosecution in the FIR is that, on 21-10-2021 at about 9.30 pm, when Shashim Pravin Shambharkar was at home, one Sunna Khan @Jahangir, Assu and one unknown person came and took Goldi with him in autorickshaw. After some time one Matinbhai came and informed that, Goldi is being assaulted by Sunna and his associates by knife at MAM Public School. It is alleged that, Sunna, Saddam, Sharik, Niyaz, Faiyyaz were present and they were assaulting his brother Bhojesh@Goldi. It is further alleged that, Bhojesh @Goldi was severely injured and when he was taken to hospital he was declared dead at the hospital. There were 62 stab wounds suffered by the deceased Bhojesh @Goldi shambharkar. After completion of investigation chargesheet came to be filed.

It was submitted that, perusal of statement of Abhishek, Virendrasingh and Pramesh who are eyewitness to the incidence would reveal that, he has narrated that, it was Sunna, Niyaz and one unknown person who has assaulted Goldi by knife and there is no allegation that, Sharik has assaulted him by means of any weapon.
