New York court upholds foreclosure dismissal after lender waited 3 years

24 Oct 2026, 05:34 PM 3 min read

A New York appeals court has upheld the dismissal of a mortgage foreclosure lawsuit after the lender waited three years to seek a default judgment against a defendant who had not responded. The decision enforces state rules that require lenders to take legal action within set deadlines. The ruling was issued on 22 October 2026 by the Supreme Court of the State of New York, Appellate Division, First Department.

The judges upheld a lower court's decision to dismiss the foreclosure case because the lender failed to act within the required time after the borrower first failed to respond. According to court filings published by the Appellate Division, First Department, the property owner did not file a formal answer or appear in court in 2018 after receiving the summons and complaint. Under Section 3215(c) of New York's Civil Practice Law and Rules (CPLR), a plaintiff must begin the process of seeking a default judgment within one year after a defendant fails to respond.

If the plaintiff misses this deadline, the court must dismiss the case as abandoned unless the lender can provide a good reason for the delay. In this case, the mortgage lender took no concrete steps to obtain a default judgment until 2021, three years after the legal deadline had passed.Strict enforcement of statutory timelinesIn its appeal, the lender asked the court to reverse the trial court's decision to dismiss the case.

It tried to explain why it had waited several years between the defendant's failure to respond in 2018 and its request for a default judgment in 2021. However, the First Department judges ruled that the lender had not provided a reasonable explanation for failing to act within the required 12-month period. The appeals court noted that CPLR 3215(c) is designed to stop lenders and financial institutions from leaving lawsuits unresolved for years while interest and administrative fees continue to build up for homeowners facing financial problems.

Under New York law, routine office tasks, informal communications or internal transfers of accounts do not meet the requirement to take active steps toward obtaining a judgment. The court stressed that when a lender has no valid legal reason for the delay, the law requires the case to be dismissed.Abandonment rules protect property titlesThe ruling supports long-standing decisions by New York state courts on cases that have been left inactive.

Property law attorneys note that enforcing CPLR 3215(c) helps protect homeowners by clearing old cases from court records and preventing unresolved lawsuits from creating lasting problems for property titles. When a court dismisses a foreclosure case as abandoned under CPLR 3215(c), the lender loses its current attempt to obtain a default judgment through that proceeding. If the six-year deadline for enforcing a mortgage has also expired during the intervening years, the lender may be legally prevented from filing a new lawsuit to collect the debt or enforce the mortgage lien.

The First Department's order formally ends the appeal and confirms the complete dismissal of the foreclosure case against the property owner. You use AI every day. Now get your AI Quotient. Take the AIQ test.
