The deceased has been identified as Jayabalakrishnan of Chittur, Cheranalloor. This is the second road accident allegedly involving teenaged drivers in Kochi within a fortnight.
The Cheranalloor police on Sunday recorded the arrest of the minor driver, reportedly the son of a judicial officer. The boy was released on bail from the police station later in the day under Section 8 of the Juvenile Justice (Care and Protection of Children) Act, 2015, according to the police. The accident occurred around 2.20 a.m. near a car showroom at Maraparambu on Container Road in Cheranalloor.
The boy was travelling alone in the car from Vallarpadam towards Kalamassery when it hit the scooter, which was moving in the same direction, as per the FIR. Cheranalloor Circle Inspector told the media that the boy was not under the influence of alcohol as per preliminary medical examination. Mr. Jayabalakrishnan, who was returning after shutting his eatery at Chittur, reportedly succumbed to his injuries on the spot.
The police have registered a case against the minor driver on charges of rash driving and rash or negligent act that does not amount to culpable homicide under Sections 281 and 106(1) of the Bharatiya Nyaya Sanhita (BNS). Later in the day, the police added Section 105 of BNS which prescribes the punishment for culpable homicide not amounting to murder in the FIR. The Section was added amid protests and criticism against the police for releasing the accused on station bail.
“Further action based on the fresh charge will be taken against the accused,” a senior police officer said. Relatives of the victim, supported by various political parties, staged protests in front of the Cheranalloor police station after the accused was let out on bail. The final rites of the victim was held at the Pachalam crematorium on Sunday. The body of the victim was shifted to the Ernakulam Government Medical College Hospital.
Mr. Jayabalakrishnan is survived by his wife Manju and three children. The accident comes days after three youths were killed after an allegedly speeding luxury car driven by a 19-year-old youth rammed the two-wheeler they were riding near Nedumbassery. Strict action sought Ernakulam MLA T.J. Vinod, meanwhile, requested Home Minister Ramesh Chennithala to examine if the police’s act of granting station bail to the minor accused was legally correct.
He said the responsibility of the car owner who permitted the minor to drive the vehicle should also come under the purview of the investigation. “There shouldn’t be any compromise in the probe on account of the family background and influence of the accused,” he said.
