New York court orders husband's loan repaid from joint home's sale proceeds

A New York appeals court has ruled that a husband who borrowed money against a home he owned before marriage is entitled to have that debt paid in full from the proceeds of selling the couple's jointly owned marital home. The ruling was issued on 22 October 2026 by the New York Supreme Court, Appellate Division, First Department, in the divorce case Menkes v Menkes. The decision explains how New York's divorce laws treat debts taken on by one spouse to buy a shared family home.

It clarifies how these financial obligations must be handled when a couple divorces and their property is divided. According to court filings published by the Appellate Division, First Department, the husband owned a residential property in his name alone before the marriage. During the marriage, the couple decided to buy a new home together as jointly owned marital property. To pay for the purchase, the husband took out a home equity loan using his separately owned property as security.

He directed the full loan amount toward buying the new family home.Court confirms equitable distribution principleAfter the marriage broke down and divorce proceedings began, the couple disagreed over how the remaining home equity loan debt should be handled when their marital assets were divided. The First Department judges ruled that because the borrowed money was used only to buy the jointly owned family home, the debt counted as a shared marital liability.

As a result, the court ordered that when the marital home is sold, the proceeds must first be used to repay the home equity loan secured against the husband's separate property. Any money left over can then be divided between the former spouses. The court explained that refusing to repay the husband from the sale proceeds would unfairly penalize him for using his own property to help buy a shared family asset.

Under New York's rules for dividing property in a divorce, courts must fairly divide both marital assets and marital debts. They consider the direct financial contributions each spouse made during the marriage.Rights over separate assets reaffirmedThe Appellate Division also clarified that taking out a loan against property owned separately by one spouse does not automatically turn that property into a marital asset.

This applies as long as the borrowed money can be clearly traced to the purchase of the jointly owned home. Family law attorneys note that the ruling supports an important principle in complex, high-value divorces across New York. When one spouse uses separate property or personal credit to help create a shared marital asset, the debt is linked to the asset it helped purchase rather than remaining solely the responsibility of the person who borrowed the money.

The Appellate Division's decision formally changes the lower court's divorce judgment. It directs the attorney handling the eventual sale of the jointly owned marital home to use the sale proceeds to pay off the husband's outstanding home equity loan balance directly. You use AI every day.
