Mississippi woman keeps $1.2m farm bought in 1994 as ex loses court appeal

A Mississippi woman has retained sole ownership of a 432-acre farm valued at approximately $1.2 million after her former husband challenged its status during their divorce. In its October 13, 2026, decision, the Mississippi Court of Appeals upheld the lower court's ruling that the property remained hers because the evidence did not establish that it had been converted into a marital asset.

According to the court's opinion published by Justia, the farm's use as security for a loan that helped finance their marital home did not automatically give her husband an ownership interest. The appeals court also upheld the allocation of additional land needed for the home's septic system.A farm purchased before marriageThe case, Wiley Bryant Harrison v. Ellen Trainor Harrison, arose from the couple's divorce and their disagreement over property division.

Ellen Harrison purchased Butler Road Farm in 1994, a decade before marrying Wiley Harrison in 2004. The property covered approximately 432 acres and was valued at around $1.2 million. During the marriage, the farm was rented to a third party rather than used as the couple's residence. Following their separation, Ellen sought a divorce, citing habitual cruel and inhuman treatment.

The Lee County Chancery Court granted the divorce and classified Butler Road Farm as her non-marital property.Wiley challenged the classification, arguing that the property's connection to their shared finances and his alleged work on the land entitled him to an interest in it. The dispute required the courts to determine whether the farm's status had changed during the marriage. Why the refinancing loan did not establish ownershipA central issue was a refinancing loan secured against Butler Road Farm.

Both spouses signed the loan documents, and some of the funds were used to finance construction of their marital home in Saltillo, Mississippi. Wiley argued that using the farm to support the couple's household finances made it a marital asset. He also claimed to have performed work on the property, including removing bridges, which he suggested contributed to its maintenance and value.Ellen maintained that she managed the farm as a rental property and paid the mortgage instalments and property taxes.

She testified that the refinancing loan was repaid using rental income, although the parties disputed whether Wiley contributed financially. The chancery court found insufficient evidence to establish that the farm had become marital property. The Court of Appeals agreed, concluding that signing a loan secured by the property did not, by itself, transfer ownership to Wiley. How Mississippi law treats separate propertyUnder Mississippi law, property acquired before marriage is generally considered non-marital.

However, separate property can become marital under certain circumstances, including commingling with marital assets or being converted through the spouses' conduct and contributions. The court considered whether the refinancing arrangement and Wiley's alleged work justified changing the farm's classification. It concluded that the evidence did not demonstrate the necessary transformation. The judges also considered whether Wiley's efforts had contributed sufficiently to the property's value.

The trial court had evaluated the conflicting testimony and found his claimed contributions inadequate to establish an ownership interest. The appeals court declined to disturb those findings. Its decision did not establish that premarital property can never become marital property. Rather, it confirmed that the evidence in this particular dispute did not justify treating the farm as jointly owned.Dispute over additional land near the homeThe husband also challenged the allocation of 2.19 additional acres from an adjoining 62-acre parcel.

The chancery court awarded Ellen the marital home and the extra land because the home's septic system extended beyond the four-acre parcel on which the house stood. Ellen testified that the additional acreage was necessary to accommodate the system. Wiley did not contradict her testimony about its location or the need for the land.He argued that the court lacked sufficient evidence to justify the allocation and had not properly established the land's value.

However, he did not provide a certified survey, appraisal or other evidence demonstrating that the valuation or allocation was incorrect. The Court of Appeals found that the evidence supported the lower court's decision. It upheld the additional acreage award as part of the overall division of property between the former spouses.Appeals court upholds the rulingOn October 13, 2026, the Mississippi Court of Appeals affirmed the chancery court's judgment, leaving Ellen with sole ownership of Butler Road Farm and upholding the distribution of the marital home and additional land.

The ruling highlights the distinction between using property to support a marriage and establishing legal ownership of it. Although the farm helped secure financing for the couple's home, the court found that this arrangement alone did not make it a shared asset. The case demonstrates why courts examine when property was acquired, how it was managed and whether a spouse's contributions changed its legal status.

In this instance, the refinancing loan and the husband's claimed work were insufficient to override the farm's classification as the wife's premarital property. You use AI every day. Now get your AI Quotient. Take the AIQ test.
