Alabama lawyer quit practice to care for parents; court voids her condo deed

25 Oct 2026, 10:23 PM 4 min read

An Alabama lawyer who left her legal career to care for her sick parents has lost her claim to part ownership of their coastal condominium. The Alabama Supreme Court upheld a decision cancelling the deed that had given her a share of the property. The court upheld a lower court ruling that voided the property transfer made in 2020. It found that state laws protecting elderly property owners take priority over the personal sacrifices family members make in exchange for property.

The decision in Schumpert v. Wallace ends a legal dispute involving former lawyer Holly Schumpert. She moved to Orange Beach, Alabama, after her parents, Alton and Patsy Schumpert, became ill and offered her half ownership of their home.Abandoning practice for family dutyIn late 2020, after both her parents suffered serious health problems, Holly Schumpert closed her law practice in Tennessee, sold her house and moved to Alabama to care for them full-time.

In October 2020, Alton and Patsy signed a warranty deed giving Holly a 50 per cent share of their Orange Beach condominium. The agreement was based on her promise to provide ongoing personal support and care. However, the property was already held in a family trust set up by her parents. The deed giving Holly a share did not mention the trust or state that Alton and Patsy were signing the document as trustees.

Holly later testified that she did not know the trust officially owned the coastal home when the deed was signed. Holly lived at the Orange Beach property and cared for her parents until early 2022. As their physical health improved and they became more independent, relationships within the family began to worsen. In July 2022, Holly discovered that her brother, Alton Schumpert Jr., planned to move into the condominium.

She then left the property and returned to Tennessee.State law protects elderly grantorsAfter relations within the family broke down, Alton and Patsy filed a lawsuit in a local circuit court. They asked the court to cancel the 2020 deed under Section 8-9-12 of the Alabama Code. The law states that a property transfer can be cancelled at the property owner's request if a key part of the agreement involves a promise to care for the owner for the rest of their life.

The rule is intended to protect older and vulnerable property owners who transfer their assets in return for promised care. Holly asked the court to change the deed to show that her parents had acted as trustees. She also filed counterclaims alleging fraud. She argued that she had kept her side of the agreement by giving up her legal career and making major financial sacrifices to care for her parents.

In May 2025, the trial court ruled against Holly. It declared the 2020 warranty deed completely invalid and confirmed that she had no legal ownership of the Orange Beach condominium. Holly then appealed to the Alabama Supreme Court.Supreme Court upholds deed annulmentThe Alabama Supreme Court unanimously upheld the lower court's decision. The justices ruled that Section 8-9-12 gives parents the legal right to cancel property transfers made in exchange for care, even if the person receiving the property has already provided some of the promised support.

In its written opinion, the court acknowledged the personal sacrifices Holly had made for her parents. However, it said the law left little room for the court to make an exception based on her circumstances. "We recognize the concerns Holly raises in her brief regarding the devotion she showed to her parents and the personal sacrifices she made on their behalf," the Supreme Court of Alabama noted in its written opinion.

"Nevertheless, in enacting § 8-9-12, the Legislature made a clear public-policy choice to protect elderly and vulnerable property owners. Our role is to enforce that legislative choice." Alton Schumpert died in October 2024. After his death, Alton Jr. was appointed the personal representative of his estate and took his place in the legal proceedings alongside Patsy. The court's ruling leaves the 2020 warranty deed cancelled.

Holly retains no ownership share or financial interest in the condominium, while the property remains under the ownership of her parents' estate and the surviving family interests. You use AI every day. Now get your AI Quotient. Take the AIQ test.
